These Terms govern your use of Flagged. By creating an account or using the service you agree to these Terms.

Plain-English summary

Flagged is an automated compliance tool, not a law firm. Documents are drafts to start from, not legal advice. You're responsible for reviewing them. Our liability is limited. See the dedicated Disclaimer page for the full version.

Our Service

Flagged provides: automated GDPR and AI compliance scanning for websites; compliance scoring and gap reporting; generation of legal policy documents including Privacy Policies, Cookie Policies, Terms & Conditions and AI Disclosure documents; a document dashboard for editing and exporting generated policies.

1. Service provider

Flagged is provided by Jack Doherty, trading as Flagged, United Kingdom. Contact: jack@flagged.org.uk.

2. Who these terms apply to

These Terms apply to all users, including UK and EU consumers. Statutory consumer rights under UK and EU law are preserved and are not affected by these Terms.

3. Account

You are responsible for keeping your account credentials secure and for any activity carried out under your account. Notify us promptly if you believe your account has been compromised.

4. Acceptable use

You may only scan websites that you own or that you have explicit permission to scan. Scanning third-party sites without permission is prohibited. We may suspend accounts that misuse the service.

5. Plans and billing

Paid plans are managed via Stripe. Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from your account.

6. Refunds and cancellation

UK and EU consumers have a 14-day right to cancel from the date of purchase and receive a full refund. Requests after 14 days are considered at our discretion. To request a refund, email jack@flagged.org.uk.

After the 14-day cancellation period, refund requests are considered at our discretion on a case-by-case basis. Factors considered include length of subscription, usage, and reason for request. To request a discretionary refund, email jack@flagged.org.uk with your account details and reason.

7. No legal advice

Generated policies, scan results, scores and any other output from Flagged are provided as a practical starting point and do not constitute legal advice. Flagged is not a law firm and use of Flagged does not create a solicitor–client relationship. You should seek independent legal advice from a qualified professional for your specific circumstances.

Compliance scores and gap reports produced by the scanner are indicative only and do not represent a formal legal audit.

8. No warranty

The service and all documents are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or legal sufficiency. We do not warrant that the service will be uninterrupted, error-free, or that any document produced will satisfy any specific legal or regulatory requirement.

9. Limitation of liability

To the maximum extent permitted by law, neither Flagged nor its operator shall be liable for any indirect, incidental, consequential, special, punitive or exemplary damages, or for any loss of profits, revenue, data, goodwill, regulatory fines or reputation arising from or in connection with your use of, or reliance on, the service or any document it produces.

Our total aggregate liability to you in connection with the service is limited to the amount you paid us in the three (3) months immediately preceding the event giving rise to the claim. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited under applicable law. UK and EU consumer statutory rights are preserved.

10. Indemnity

You agree to indemnify, defend and hold harmless Flagged and its operator from and against any and all claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) brought by a third party and arising out of or related to: (a) your use of the service; (b) your publication, distribution or reliance on any document generated by Flagged; or (c) your breach of these Terms, except to the extent caused by our own gross negligence or wilful misconduct.

9. Changes to the service and these terms

We may update these terms with reasonable notice. A material change is any change that affects your rights, the price of your plan, or the core functionality of the service. Material changes will be notified by email at least 30 days before they take effect. Continued use after that date constitutes acceptance.

10. Governing law

These Terms are governed by the laws of England and Wales, and disputes are subject to the non-exclusive jurisdiction of the courts of England and Wales. EU consumers retain the right to bring claims under their local consumer protection laws.

Data Protection

Your use of Flagged involves the processing of personal data. Please review our Privacy Policy at compliancetoolkit.lovable.app/privacy for full details of how we collect, use and protect your data, and how to exercise your rights.

Intellectual Property

Flagged and its content, features and functionality are owned by Jack Doherty trading as Flagged and are protected by UK and international intellectual property laws. Generated policy documents produced by the service for your website are yours to use — we claim no ownership over documents generated on your behalf. You may not copy, reproduce or distribute the Flagged platform, interface or underlying technology without written permission.
